UAE visas and residency for Australian founders & families

In shortAustralians can live in the UAE on an employment visa, an investor or partner visa through a company, a Golden Visa, a Green Visa or a remote work visa, and can sponsor a spouse and children. The visa is the easy part. Australia has no tax treaty with the UAE, so ceasing Australian tax residency needs separate planning.

Which UAE visa can an Australian founder or family use?

There is no single Australian route. The right visa follows what you are doing in the UAE. Here is how the main options compare.

RouteSuitsMain catch
Employment visaAustralians hired by a UAE employerTied to the employer, who handles it
Freezone investor or partner visaFounders with a company in DMCC, IFZA, Meydan, RAKEZ or ADGMVisa numbers depend on the freezone package and office type
Mainland investor or partner visaFounders trading directly in the local marketNeeds a mainland licence and a suitable office
Golden VisaInvestors, entrepreneurs, specialised talentCategory-specific criteria, which change
Green VisaSkilled workers, freelancers, self-employedEligibility rules apply to each category
Remote work visaPeople employed or earning from abroadNo UAE company, so no local business substance

Official detail sits with the Federal Authority for Identity, Citizenship, Customs and Port Security and the UAE government portal. Dubai-specific processing runs through GDRFA Dubai.

How does residency work if I set up a company?

For most founders this is the main route. You form a company, usually in a freezone, and the company sponsors your investor or partner visa. Emirates ID, a medical test and biometrics follow.

The decisions that matter come before the paperwork. Which freezone, how many visas you need, whether a flexi-desk is enough or you need a physical office, and whether the structure will pass a bank’s questions later. A cheap licence with no real activity behind it is the most common mistake we see, and it tends to cause trouble at the banking stage, not the visa stage.

Abu Dhabi suits founders who want ADGM’s common-law framework. RAKEZ suits tighter budgets. Sharjah’s SHAMS suits media and creators. Dubai remains the default for most. If you want a view on which structure fits, our visas and residency service covers it.

Can I bring my family from Australia?

Yes. A resident can generally sponsor a spouse and children, and parents on stricter conditions. Salary or income requirements and accommodation proof apply, and they vary by visa type and emirate, so check current rules before you commit to a lease or a timeline.

Allow time for documents. Australian marriage and birth certificates normally need legalising before UAE authorities accept them. Schooling is the other planning item, since school availability and fees differ widely between emirates and curricula.

Does UAE residency end my Australian tax residency?

No, and this is where Australian leavers most often go wrong. Getting the visa and ceasing Australian tax residency are two separate things.

Australian residency for individuals turns on the common-law “resides” test plus three statutory tests (domicile, 183 days, and the Commonwealth superannuation test). It is facts and circumstances, not a simple day count. A long-proposed “bright line” reform has been recommended, but as far as we could verify in October 2026 it has not been legislated. The ATO is the primary source.

Several consequences follow for people who do cease residency:

  • Capital gains: ceasing residency triggers CGT event I1, a deemed disposal at market value of assets that are not taxable Australian property. You can elect to keep those assets in the Australian CGT net instead, which defers the tax rather than removing it.
  • No treaty: Australia has no double tax agreement with the UAE. The Australia-UAE CEPA is a trade agreement. There are no treaty tiebreakers and no treaty relief on this corridor.
  • Superannuation: it stays preserved under Australian rules. Moving overseas does not unlock it.
  • Your Australian home: selling it while a non-resident can affect the CGT main-residence exemption. Take advice before you list it.

A UAE tax residency certificate from the Federal Tax Authority evidences UAE residence. It does not settle the Australian question. For anything finer than this, you need Australian-qualified tax advice alongside the UAE setup. Our Australia corridor page explains how we work with that.

What are the common mistakes?

  • Treating the UAE visa as the end of the Australian tax question.
  • Choosing a freezone on price before checking visa quotas and banking.
  • Assuming a remote work visa gives the same standing as a company and an investor visa.
  • Leaving family documents until after arrival.
  • Staying outside the UAE long enough to put a standard residence visa at risk.

The visa side is routine once the structure is right. The sequencing between Australian exit and UAE arrival is what deserves the thought.

Questions people ask

Can Australians get UAE residency?

Yes. Australians qualify through employment, through owning or partnering in a UAE company, through a Golden or Green Visa, or through the remote work route. Which one fits depends on whether you are hired, building a company or running income from abroad.

Can an Australian get a UAE Golden Visa?

Yes, if you fit one of the Golden Visa categories, such as investor, entrepreneur or specialised talent. Criteria and financial thresholds change, so check the current rules on the official portals before planning around them. It is a long-term residence visa, currently ten years.

Can my Australian family live in the UAE with me?

Residents can generally sponsor a spouse and children, and parents on stricter terms. Salary or income and housing requirements apply and vary by emirate and visa type. Australian marriage and birth certificates usually need to be legalised before the UAE will accept them.

Does UAE residency stop me being an Australian tax resident?

No. Australian tax residency is decided under Australian law, using the common-law test and three statutory tests, not by holding a UAE visa. A UAE residence visa or tax residency certificate does not by itself end it.

How long does UAE residency last for Australians?

It depends on the visa. Employment and freezone visas are issued for a fixed term and renewed, while the Green Visa and Golden Visa run longer. Standard residence visas can lapse if you stay outside the UAE for an extended period, so check the current absence rules.

Where this gets specific to you: how the Australian rules land depends on your residency status, your income types and what you keep in Australia. The general picture is a start; your plan needs your numbers and Australian-qualified advice.
